The NLRA and Nonunion Employees
|

A SHRM CT State Council Webinar
Did you know that many of the protections provided by the National Labor Relations Act (NRLA) extend to nonunion, as well as union workers? For instance, whether or not a workplace is unionized, Section 7 of the NLRA protects employees' rights to engage in concerted activity. This protection extends beyond outright organizing and can encompass activities such as discussing or complaining about compensation or terms or conditions of employment. Recent decisions by the National Labor Relations Board (NLRB) on "protected concerted activity" expand employee rights and may call into question certain employer policies. Do your policies comply? What is needed for the policies to be lawful? For example:
• Many employers have begun to implement social media policies prohibiting employees from disparaging the employer on social media sites. The NLRB has ruled that many of these policies violate the NLRA.
• Some employers have policies prohibiting employees from speaking to the media without prior authorization by management. The NLRB has found that some of these policies unlawfully chill employees' rights to publicize their grievances.
• Some employers require employees to agree to waive their right to pursue class action claims. The NLRB recently found such waivers unlawful.

Coming to Grips with the “New” ADA
|
|
|
The ADA Amendments Act and the EEOC’s 2011 Regulations implementing that Act confirm the dramatic expansion of ADA protections for employees and obligations of employers. With the “new” definition of “disability,” every employee with a medical condition is a potential plaintiff. Those on medical leave, whether workers compensation or short or long term disability, pose perhaps the greatest concern.
Beginning on February 16, we are offering a 4-part Breakfast Series on the new ADAAA regulations. The program will assist HR professionals and in-house counsel prepare to “re-educate” managers and supervisors on ADA compliance, including strategies for adopting and enforcing legitimate performance, conduct and attendance expectations.
